These Terms and Conditions (“Terms”) govern your use of the website, content, and services provided by Nihongo Musubi, an online Japanese language coaching provider based in New Delhi, India. By accessing or using our website or enrolling in any of our programs (“Services”), you agree to be bound by these Terms. If you do not agree, please do not use our Services.

  1. Company and Services
Nihongo Musubi (“we”, “us”, “our”) offers primarily digital, education-focused services, including but not limited to live online classes, recorded sessions, study materials, workshops, and other Japanese language–related content. We may modify, expand, or discontinue parts of the Services at our discretion, with or without prior notice.
  2. Fees, Payments and Taxes
All course fees, subscription fees, or other charges are specified on our website or communicated directly to you at the time of enrollment. Fees are payable in advance and must be paid in full for confirmation of enrollment, unless otherwise explicitly agreed in writing. We may revise our pricing, introduce new plans, or offer limited-time discounts at any time. Such changes will not affect fees already paid for ongoing batches or courses. You are responsible for any applicable taxes, charges, or levies imposed under applicable law.
  3. Class Access, Schedules and Changes
Our Services are delivered primarily through digital platforms (e.g., video conferencing tools, learning management systems, or messaging platforms). Class schedules, batch timings, and course duration will be shared at the time of enrollment and are subject to reasonable changes based on instructor availability, public holidays, or operational needs. We will make reasonable efforts to inform you in advance of any rescheduling, and missed classes due to our side may be rescheduled or compensated through make‑up sessions where feasible. We are not responsible for your inability to attend a scheduled class due to personal reasons, connectivity issues, or device problems at your end.
  4. Cancellations, Refunds and Transfers
Because we plan batches, allocate instructor time, and provide materials in advance, fees once paid are generally non‑refundable, except where mandated by applicable law or explicitly stated otherwise in a written policy.
Any request for cancellation, refund, or batch transfer will be considered on a case‑by‑case basis and remains at the sole discretion of Nihongo Musubi.
  5. Use of Learning Materials and Intellectual Property
All course content, including but not limited to notes, slides, recordings, worksheets, quizzes, PDF handouts, logos, branding, and website content, is owned by Nihongo Musubi or used under license. You are granted a limited, non‑exclusive, non‑transferable license to use the materials solely for your personal learning. You may not copy, record, sell, distribute, publish, upload, or share these materials publicly or with any third party without prior written consent. Unauthorized reproduction or distribution of our materials may result in termination of access and may give rise to civil or criminal liability.
  6. Online Conduct and Classroom Etiquette
You agree to use our website, classes, and community spaces (including WhatsApp/Telegram groups or forums) responsibly and respectfully. You must not:
    ● Harass, abuse, or disrespect instructors, staff, or other learners.
    ● Share offensive, discriminatory, or illegal content.
    ● Disrupt live classes (for example, by spamming, trolling, or intentionally disturbing the session). We reserve the right to remove you from a class, group, or the program, without refund, if your behaviour is found to be inappropriate, abusive, or in violation of these Terms.
  7. Technology, Access and Third‑Party Platforms
Our Services may rely on third‑party tools (video conferencing platforms, payment gateways, communication apps, etc.). While we make reasonable efforts to choose reputable providers, we do not control their performance, uptime, or policies and are not liable for outages, technical issues, or data handling practices of such third parties. You are responsible for maintaining your own internet connection, compatible device, and necessary software to access the Services.
  8. Disclaimer of Warranties
Our Services are provided on an “as is” and “as available” basis. We do not guarantee that:
    ● You will achieve a specific JLPT level, score, or certification.
    ● Access to the website or online classes will be uninterrupted, timely, or error‑free. Your progress depends on your own effort, attendance, practice, and other individual factors.
  9. Limitation of Liability
To the maximum extent permitted by applicable law, Nihongo Musubi and its owners, instructors, staff, and affiliates shall not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with your use (or inability to use) our Services. Our total aggregate liability for any claim relating to the Services shall not exceed the total fees actually paid by you to Nihongo Musubi for the specific course or batch giving rise to the claim.
  10. Indemnity
You agree to indemnify, defend, and hold harmless Nihongo Musubi, its owners, employees, instructors, and partners from any claims, damages, liabilities, losses, or expenses (including legal fees) arising out of your:
    ● Use of the website or Services;
    ● Violation of these Terms; or
    ● Infringement of any third‑party rights, including intellectual property or privacy rights.
  11. Privacy and Data Protection
We collect and process certain personal information (such as your name, contact details, and payment information) to provide and improve our Services. By using our Services, you consent to the collection and use of your information in accordance with our Privacy Policy, which will describe how we handle, store, and protect your data. We will take reasonable steps to safeguard your information but cannot guarantee absolute security of data transmitted over the internet.
  12. Changes to Services and Terms
We may update, modify, or discontinue any part of the Services or these Terms at any time. When we make material changes to the Terms, we will update the date at the top or bottom of this document and may provide additional notice where appropriate (e.g., via email or website notice). Your continued use of the website or Services after such changes constitutes your acceptance of the revised Terms.
  13. Third‑Party Links
Our website or communications may contain links to third‑party websites or resources. These are provided for convenience only. We do not endorse and are not responsible for the content, products, services, or practices of any third‑party sites.
  14. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect.
